OVERVIEW

This website is operated by Sweet Cake Decorations, a trading name of Malgorzata Gapinska, a sole trader. Throughout the website, the terms “we”, “us” and “our” refer to Sweet Cake Decorations.

These Terms of Service explain the rules that apply when you visit our website or purchase our products. By using this website or placing an order, you agree to these Terms, together with our Privacy Policy, Return and Refund Policy and Shipping Policy.

Nothing in these Terms affects your statutory rights under UK consumer law.

  1. PRODUCTS

We sell edible cake toppers, cupcake toppers, cake wraps and related edible cake decorations.

We make every reasonable effort to display product descriptions, sizes, colours and images accurately. However, colours may vary slightly depending on the customer’s screen, printer output and the edible material selected.

Customers should read the complete product description and check the selected size, material, shape, personalisation and cutting option before placing an order.

Product ingredients, allergen information, storage instructions and shelf-life information are provided where applicable. Customers are responsible for checking that a product is suitable for their individual dietary requirements before use.

  1. PERSONALISATION

Customers are responsible for providing accurate personalisation details, including names, dates, ages, messages, photographs and requested designs.

Please check all spelling, punctuation, dates and other information carefully before submitting an order. We are not responsible for errors contained in information supplied or approved by the customer.

Where a digital draft is provided, the customer is responsible for checking it carefully. If we do not receive a response within the stated production timeframe, we may print the draft as supplied in order to avoid delaying dispatch.

Once production or printing has started, personalised or custom-made orders cannot normally be changed or cancelled.

  1. CUSTOMER-SUPPLIED CONTENT

By submitting a photograph, logo, image, design or other content, the customer confirms that they have the necessary permission or rights to use that content for the requested product.

Customers must not submit unlawful, offensive or infringing material. We reserve the right to refuse or cancel an order if we reasonably believe that the supplied content cannot lawfully or appropriately be used.

Customer-supplied content will be used only as necessary to produce and fulfil the order, in accordance with our Privacy Policy.

  1. ORDERS

Placing an order constitutes an offer to purchase. An order is accepted when we send confirmation that it has been accepted or begin producing the product.

We reserve the right to refuse or cancel an order where:

  • the product is unavailable;

  • payment cannot be authorised;

  • the information provided is incomplete;

  • the order cannot be produced as requested;

  • an obvious pricing or description error has occurred; or

  • the requested content may be unlawful or infringe third-party rights.

If we cancel an order after payment has been taken, we will issue an appropriate refund.

  1. PRICES AND PAYMENT

All prices are displayed in pounds sterling unless stated otherwise.

The total price, including any selected delivery charge, will be shown before checkout is completed. Customers are responsible for providing accurate billing and payment information.

We reserve the right to change prices at any time. Price changes will not affect orders that have already been accepted.

  1. SHIPPING AND DELIVERY

Orders are dispatched using the delivery service selected or stated at checkout.

Estimated delivery dates are not guaranteed delivery dates unless the customer has purchased a service expressly described as guaranteed. Carrier delivery aims may be affected by delays outside our reasonable control.

We remain responsible for the goods until they are delivered to the customer or a person identified by the customer to receive them.

Customers are responsible for providing a complete and accurate delivery address. Additional costs caused by an incorrect or incomplete address supplied by the customer may be charged to the customer where permitted by law.

  1. RETURNS, CANCELLATIONS AND REFUNDS

Personalised and custom-made products cannot normally be returned or refunded because the customer has changed their mind.

Opened edible products cannot be returned for health and hygiene reasons unless they are faulty, damaged, incorrect or not as described.

Eligible non-personalised products may be cancelled and returned in accordance with our Return and Refund Policy and applicable UK consumer law.

If an order arrives damaged, faulty, incorrect or not as described, customers should contact us as soon as possible at sweet_cake_decorations@hotmail.com and provide their order number and photographs of the product and packaging where appropriate.

Nothing in this section limits the customer’s statutory rights.

  1. WEBSITE USE

Customers may use this website only for lawful personal use. Customers must not:

  • interfere with the operation or security of the website;

  • introduce viruses or malicious code;

  • attempt to gain unauthorised access to the website or another customer’s account;

  • copy, reproduce or commercially exploit website content without permission;

  • use the website for fraudulent or unlawful purposes; or

  • provide false or misleading information.

We may restrict access to the website where reasonably necessary to protect the business, customers or website security.

  1. INTELLECTUAL PROPERTY

Unless otherwise stated, the website’s original text, branding, layout, photographs and original designs belong to Sweet Cake Decorations or are used with permission.

No website content may be copied, reproduced, distributed or used commercially without prior written permission, except where permitted by law.

Third-party names, characters, logos and trademarks remain the property of their respective owners. Their appearance does not imply sponsorship, approval or affiliation unless expressly stated.

  1. THIRD-PARTY SERVICES

Our website may use or link to third-party services, including Shopify, payment providers, analytics services and delivery providers.

Those third parties may have their own terms and privacy policies. We are not responsible for the content of unrelated third-party websites, but this does not affect our responsibilities for products purchased directly from Sweet Cake Decorations.

  1. PRIVACY

Personal information is handled in accordance with our Privacy Policy and applicable UK data protection law.

Shopify and other service providers may process information where necessary to operate the website, process payments, fulfil orders, provide analytics or deliver services.

  1. LIABILITY

We do not exclude or limit liability where doing so would be unlawful. This includes liability for:

  • death or personal injury caused by negligence;

  • fraud or fraudulent misrepresentation;

  • defective products where liability cannot legally be excluded; and

  • the customer’s statutory consumer rights.

Subject to these protections, we are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from a purchase made for personal use.

  1. EVENTS OUTSIDE OUR CONTROL

We are not responsible for delays caused by events outside our reasonable control. If such an event materially affects fulfilment of an order, we will contact the customer where reasonably possible and take appropriate steps to minimise the delay.

This section does not remove any rights the customer may have if an order is not delivered within an agreed or legally required timeframe.

  1. CHANGES TO THESE TERMS

We may update these Terms when necessary to reflect changes to our business, website, services or legal obligations.

The Terms applying to an order will normally be those in effect when the order was placed, unless a change is required by law.

  1. GOVERNING LAW

These Terms are governed by the laws of England and Wales.

Customers living elsewhere in the United Kingdom retain any mandatory protections provided by the law applying in their part of the United Kingdom.

Any dispute may be brought before the courts that have jurisdiction under applicable consumer law.
